This policy sets out the terms between you and Digo Creative Network Ltd and Digo Ltd under which you may access this website www.designbydigo.com. This policy applies to all users of, and visitors to this website.

Your use of this Website means that you accept, and agree to abide by, all the policies present in this terms of use.

We may from time to time provide secure informational services and file sharing services on this Website including the client area on www.designbydigo.com (‘Client Space’). This allows you to readily provide design, artwork and other files.

    When accessing the Client Space you agree that:

  • You will not access without authority, interfere with, damage or disrupt any files that may be stored in the Client Space that do not belong to you;
  • You will treat all information in the Client Areas as strictly confidential in accordance with our Confidentiality Terms set out below.
  • you will not seek to access or view any files that are not owned by you; and
  • any files, images or software you upload to our Websites and/or the Client Areas will comply with the Content Standards set out below.

Confidentiality

By accessing the secure services provided by www.designbydigo.com (‘Client Space’), you will be accessing information that is subject to copyright protection, is confidential and is commercially valuable to Digo Ltd(“Confidential Information”).

In consideration of Design by Digo providing Confidential Information to you, you therefore agree to abide by these Confidentiality Terms and agree:

  • To keep the Confidential Information secret and confidential;
  • Not to disclose nor permit the disclosure of any Confidential Information to any person without the prior written consent of Digo Ltd;
  • Not to use the Confidential Information for any pupose, whether commercial or non-commercial, other than for your internal business purposes;
  • To make only such limited number of copies of the Confidential Information as are reasonably required for your internal business purposes; and
  • To take proper and all reasonable measures to ensure the confidentiality of the Confidential Information.

“Confidential Information” includes but is not limited to:

  • information provided in electronic, documentary or in other tangible or intangible form and which at the time of provision is marked or otherwise designated to show expressly or by necessary implication that it is given in confidence; and
  • all information accessible in any password protected areas of our website including but not limited to the client space of www.designbydigo.com.

At Design by Digo’s request you agree to return and provide to us all documents and other materials that contain any Confidential Information, and to permanently delete all electronic copies of Confidential Information from your computer systems.

You acknowledge and agree that any breach of these Confidentiality Terms could cause damages to Digo Ltd. In the event of a breach or threatened breach by you, Digo Ltd shall be entitled to injunctive relief in any court of competent jurisdiction and you agree that you shall not oppose any such application. You also agree to indemnify Digo Ltd against all costs, claims, demands and liabilities arising directly or indirectly out of a breach.

The validity, construction and performance of these Confidentiality Terms shall be governed by English law and other relavant international law and shall be subject to the non-exclusive jurisdiction of the courts of England and Wales, to which you agree to submit.

Content Standards

These content standards apply to any and all material which you post to my Website (including any Client Space,) (’Postings’).

Payment & Pricing

By hiring Design by Digo, you agree to the following:

  • All Prices must be agreed on, before commencement of any work can take place.
  • An agreement in which you must agree to will be sent before commencement of any work can take place.
  • All customers outside of the European Union are subject to payment in full. Customers within the European Union are subject to a non-refundable 50% deposit of the total.
  • In some cases where prices are approximated, we reserve the right to amend the price accordingly.
  • We reserve the right to cancel a project and issue a refund without consent
